Comprehensive Privacy Notice (updated November 2025)
1. Identity and address of the responsible party
BioDental Care SC, hereinafter “BioDental Care”, with address at Paseo Centenario #10310,
11th floor, offices 1101 and 1102, Zona Urbana Río Tijuana, CP 22010, Tijuana, Baja California,
Mexico, and the internet portal www.biodentalcare.com, is responsible for the processing and
protection of your personal data.
This Privacy Notice is issued in accordance with the Mexican Political Constitution of Mexico,
the Federal Law on the Protection of Personal Data Held by Private Parties (new Law
published in the Official Gazette of the Federation on March 20, 2025), its Regulations and
other applicable provisions, as well as the General Health Law, its Regulations on the provision
of medical care services and the Official Mexican Standards on clinical records and health
information systems.
2. Personal data we collect
To fulfill the purposes described in this Privacy Notice, BioDental Care collects and processes
the following categories of personal data:
1. Identification data: name, surname, marital status, place and date of birth, nationality,
age, handwritten signature, internal patient codes or identifiers.
2. Contact information: address, landline and mobile phone numbers, email address, and
emergency contact information.
3. Employment and socioeconomic data: occupation, approximate income (when
necessary for payment or financing options), payment compliance history.
4. Financial and asset data: billing data, bank information for collection, insurance policy
data, and coverage amounts.
5. Insurance company information: policy number, dental insurer, U.S. Social Security
Number (if applicable).
6. Health data (sensitive): medical history, diagnoses, treatments, studies, clinical
evolution, habits, and risk factors.
7. Biometric data and image: intraoral and extraoral photographs, radiographs, 3D
models, 3D tomographies, scans, video, and audio recordings within the clinic.
8. Communication records: recording of calls, emails, SMS, messages on messaging
platforms, and digital forms.
3. Purposes of the processing
Primary purposes
1. Providing dental health services.
2. Integration and updating of the clinical record.
3. Appointment scheduling and payment management.
4. Insurance claim filing and reimbursement management.
5. Safety, quality control, and regulatory compliance.
6. Clinical documentation, interconsultations, and technological support.
Secondary purposes
1. Sending information about new services and promotions.
2. Reminders for preventive check-ups and dental health campaigns.
3. Satisfaction surveys and market research.
4. Preparation of statistical reports with disaggregated data.
4. Processing of video surveillance, call recording, and electronic media
4.1 Video surveillance in facilities
BioDental Care’s facilities have video surveillance cameras and audio systems that record
continuously in operating rooms, common areas, reception, waiting room, and recovery
room, for the following purposes:
1. To ensure the safety of patients, companions, staff, and property.
2. Monitor and evaluate the quality of care.
3. Document clinical and safety aspects.
4. Prevent or investigate incidents, thefts, or acts of negligence.
While the patient or their companions remain within our facilities, it is implied that tacit
consent is given for video- and audio-recording in these areas, in accordance with the
provisions of this Privacy Notice. Retroactive revocation of consent does not apply.
The recordings are stored on secure servers with restricted access and are kept for a maximum
of 90 calendar days, unless there is an investigation or legal requirement.
4.2 Recording of telephone calls
Calls to BioDental Care numbers are recorded for quality control, clarification, or clinical
documentation purposes. If the user continues the call after hearing the warning, it is
considered tacit consent. When recordings are integrated into the clinical record, they are
treated as sensitive personal data.
4.3 Preservation of emails, SMS, and instant messages
BioDental Care retains emails, SMS messages, and messages sent to its official channels as part
of the clinical and administrative history for handling quotes, clarifications, and quality control.
5. Legal basis for the treatment

6. Transfers of personal data
BioDental Care may share data with insurance companies, laboratories, specialists, technology
providers, external consultants, and competent national or international authorities, solely for
the purposes described. When required, written consent will be requested.
7. ARCO rights and other rights
The data subject may exercise their rights of Access, Rectification, Cancellation, and
Opposition (ARCO), as well as revoke their consent or limit the use or disclosure of their data,
by sending a request to privacy@biodentalcare.com or by submitting it to the clinic’s address,
addressed to the Administrative Department – Personal Data.
8. Storage periods
1. Clinical records: minimum 5 years after the last care.
2. Accounting documents: in accordance with tax deadlines.
3. Video recordings: maximum 90 calendar days.
4. Recordings of calls and messages: minimum 5 years after the last service.
9. Competent authorities
The Anti-Corruption and Good Governance Secretariat, or the federal agency Transparency
for the People, is the only authority legally recognized as competent to handle and resolve any
disputes or complaints regarding the treatment of personal data

Any changes will be published on www.biodentalcare.com and at our physical facilities.
